Class Action against BC Provincial Government Part 1
Tina Mak, Coldwell Banker Realtor and Founding President of AREAA Vancouver interviewed Jay Straith on this serious matter. Jay, 40 years as a lawyer in Alberta and BC working both as crown and defence counsel. He currently practices civil and criminal litigation with Straith and Associates in North Vancouver. He has been involved in numerous Charter or Rights cases and has been involved in legal issues concerning the issue of federal and provincial jurisdiction. Under the heading of "Equality Rights" this section states:
15. (1) Every individual is equal before and under the law and has the right to the equal protection and equal benefit of the law without discrimination and, in particular, without discrimination based on race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.
(2) Subsection (1) does not preclude any law, program or activity that has as its object the amelioration of conditions of disadvantaged individuals or groups including those that are disadvantaged because of race, national or ethnic origin, colour, religion, sex, age or mental or physical disability.
